Yes, ICA could be based on just having a human body. It would not even have to be “presence in the US plus a human body” — it could be offered to every human in the world or even every vertibrate in the world. I am not advocating a particular eligibility rule, just stating that you need one. The human body rule is a legitimate option to put on the table.
